Welcome to TICKETPLUS, thank you for using our platform. We kindly ask that you carefully read the Terms and Conditions set forth below, which govern the use of the website www.ticketplus.cl and the purchase of tickets and other associated products through it.
FIRST: Background.
TICKETPLUS SPA owns the software, brand, and all other copyrights and intellectual property rights of the platform known as “TICKETPLUS”.
TICKETPLUS is a computer application, which includes the Application and the Website, as well as any subdomain thereof, and any other Website through which TICKETPLUS services are made available for the purchase and sale of tickets and other products associated with events of various kinds, such as artistic, cultural, and/or sporting shows, distinguished by its design, speed, and security in providing said service. It also includes applications for mobile phones, tablets, and other smart devices, as well as application program interfaces and all associated services. Hereinafter, the Website, the Application, the Software, and the TICKETPLUS Services shall be collectively referred to as the “TICKETPLUS Platform”, whether under its current name or any other name it may bear in the future.
TICKETPLUS is the exclusive property of TICKETPLUS SpA, Tax ID No. 76.468.188-6, with registered address at Alonso de Córdova 5320, 16th floor, Las Condes, Metropolitan Region, and is legally represented by Mr. Chien-Fu Chen, consultas@ticketplus.cl.
This instrument governs the use of the website www.ticketplus.cl and all subdomains of said page, as well as the scope of services provided by the TICKETPLUS Platform to the Buyer or User.
TICKETPLUS acts as an agent, that is, on behalf of and by order of the “Principal” or the “Organizer” of the event or show, providing ticket sales services to the latter. The Organizer is responsible for the production and organization of the event, in a timely manner and in accordance with the law, with TICKETPLUS acting solely as its agent.
TICKETPLUS complies with current legislation in the exercise of its commercial activities, especially Law No. 19,628 on the Protection of Private Life and Law No. 19,496 on the Protection of Consumer Rights.
SECOND: Acceptance of Terms and Conditions.
The Buyer or User, upon registering and/or creating a profile on the Website for the purpose of purchasing event tickets, must previously and fully accept the Terms and Conditions established on our Website. The Terms and Conditions may be updated periodically, with modifications applying only to events published by the Event Organizer after said notification. From that moment on, the document available on the Website shall be deemed updated.
In view of the above, we recommend that our Users review the Terms and Conditions frequently and, in any case, always before making a purchase of tickets or E-tickets, so that, if they do not agree with them, they may refrain from using our service.
THIRD: Conditions of Use of the TICKETPLUS Platform.
To use our TICKETPLUS Platform, the User must first create a profile for exclusively personal use. To create a User profile, personal data that the User must provide is requested. The User guarantees and hereby declares the truthfulness, accuracy, and validity of their data. The User shall be liable for any damages arising from non-compliance with the aforementioned obligations.
It shall be the sole responsibility of the User to keep their information on the TICKETPLUS Platform up to date. The User is solely responsible for the truthfulness of the information provided when registering their profile.
The User's account is personal, private, and non-transferable. Under no circumstances should the User allow anyone else to access this site with their account, nor share their secret password with third parties. By using the password assigned to the User's account, it is presumed that the person logging in is indeed the User and not someone else. The User must strictly comply with the aforementioned Terms and Conditions.
In the event that the User forgets their password, TICKETPLUS may modify it by assigning a new one using encryption methodology. After the change has been made, TICKETPLUS will inform the User of their new password so that they may freely choose another one, modifying the one assigned by TICKETPLUS.
TICKETPLUS may require additional information from the User for a specific event in which they wish to participate. In these cases, the information will be requested at the time of purchasing the ticket online. The information provided by the User will be stored for the sole purpose of delivering it to the Organizer. TICKETPLUS is responsible for ensuring that this information is only received by the Event Organizer and undertakes to keep it protected. TICKETPLUS uses the highest technology to safeguard the personal information of Users; however, we inform you that, to date, there is no mechanism that is completely immune to cyberattacks by third parties seeking to intercept or obtain information illegally or without authorization.
FOURTH: Sales Conditions.
The main business of TICKETPLUS SpA is the sale of tickets and products associated with events of various kinds through the TICKETPLUS Platform. To purchase tickets, you must access www.ticketplus.cl, where you can find the event listings you can attend, the date and location where they will take place, and the prices of the different tickets.
TICKETPLUS will sell tickets to Users through its Website and only, for certain events, will sell them physically at the entrance to the respective event or at another location determined by the Organizer for their event.
The final price of each ticket through TICKETPLUS will consist of the following items:
Base Price of the ticket according to the selected section or the type of ticket chosen by the User;
Service Charge collected by TICKETPLUS for the selected event. The service charge is applied to each ticket purchased and corresponds to the ticket sales service provided by TICKETPLUS.
The Organizer shall set the Base Price of the tickets, as well as the characteristics of the event and its venue. Likewise, the Organizer guarantees the proper execution of the event and its security.
The User must review the details of their purchase before confirming it and, subsequently, only if they agree with all the information provided, complete the ticket purchase.
TICKETPLUS, pursuant to the provisions of article 3 letter b) and article 3 bis letter b) of Law No. 19,496 on the Protection of Consumer Rights, expressly informs that no changes, refunds, or returns will be made at the sole discretion of the buyer once the purchase process has been completed by the buyer who acquires one or more tickets to an event; that is, there is no right of withdrawal.
At TICKETPLUS you can purchase your ticket or E-ticket through Transbank debit, Multicaja, electronic transfer; Khipu; Transbank credit; Servifácil (available at Líder, Acuenta, and Ekono supermarkets); Servipag; and Multicaja Cash.
The transaction will be subject to verification of the User's data by the banking entity or other entity, as applicable.
Each registered person has a purchase limit of 6 tickets per event, unless a different maximum limit has been established by the Organizer, which will be communicated in a timely manner.
We reiterate that before confirming the purchase through the TICKETPLUS Platform, the User must carefully verify that their personal data is correct and up to date, and that the event details they wish to attend match exactly with their interests. We also reiterate that no changes, returns, or refunds of tickets will be made at the sole discretion of the User, except as established in clause seven regarding the Ticket Return Policy.
FIFTH: Ticket Delivery.
Once the purchase of the ticket(s) has been confirmed by the User, the corresponding E-Ticket will be sent to their email address, according to the information the User provided at the time of registration. Each E-ticket contains a “QR” code or other proprietary code, which will be validated at the entrance gate where the event will take place.
The User may print their E-Ticket or present it from their mobile phone in order to attend the event.
A “ticket” shall be understood as that receipt printed by TICKETPLUS that grants the right of admission to an event; and an “E-Ticket” shall be understood as that receipt received by the Buyer via email, which contains a “QR” code granting the right of admission to the event.
The ticket is a bearer instrument; therefore, it must be kept with due care, avoiding possible damage that could prevent its validation upon entering the event. The User shall be responsible in case of loss, theft, or deterioration of the tickets.
The E-Ticket can be printed as many times as necessary from the website www.ticketplus.cl, notwithstanding that the code used to enter the event is unique and can only be validated once prior to entering the event.
On occasions when the Organizer also requests the sale of printed tickets, TICKETPLUS will issue them using a thermal printing system. Regarding tickets printed on thermal paper, TICKETPLUS informs that they must not be directly exposed to sunlight or extreme environmental conditions, as the ticket may be affected and, consequently, its use may be rendered impossible. Additionally, it is recommended not to apply heat or cold to printed tickets so as not to alter the security features contained therein. Such circumstances could alter the printed tickets and potentially render them unusable.
The User shall be responsible for the loss, theft, or deterioration of tickets already in their possession.
SIXTH: Ticket Characteristics.
E-tickets or tickets are purchased through the Website www.ticketplus.cl, or through enabled physical points of sale, as applicable. These E-tickets or tickets are valid only for the day, time, and event specified, and cannot be used for other events, no matter how similar they may be. The only exception to the above shall occur in the event that the event is postponed, which will be communicated to Users in a timely manner, who may choose to: (i) use the ticket for the event scheduled to replace the one that was cancelled; or, (ii) request a full refund of the amount paid for the ticket.
E-tickets and tickets are bearer instruments; therefore, the User assumes responsibility for their E-Ticket or ticket once acquired through the Website www.ticketplus.cl, or through a Point of Sale. After the code has been verified at the event entrance, the same code may not be used again. For this reason, the User must exercise due care and avoid loss, theft, or deterioration of the ticket.
E-Tickets and tickets are non-refundable, unless permitted by the Organizer or in the event of a postponement or cancellation of the event in accordance with the policies established in these terms and conditions.
SEVENTH: Ticket Return Policy.
In accordance with the provisions of Law 19,496 (as amended by Law No. 21,398), article 3 bis letter b), regarding the right of withdrawal, which states its applicability: “In contracts entered into by electronic means, and in those in which an offer made through catalogs, advertisements, or any other form of distance communication has been accepted. Only in the case of contracting services, the provider may provide otherwise, and must inform the consumer about such exclusion, in an unequivocal, prominent, and easily accessible manner, prior to entering into the contract and paying the service price,” the Ticketing Company expressly declares that no changes or returns will be made once the purchase process has been completed; therefore, the right of withdrawal does not apply. For this reason, we invite our consumers to carefully review their order details before confirming the purchase.
The only exception shall be in cases where the consumer has voluntarily purchased the insurance available at the time of buying the ticket, in which case the conditions thereof shall be fully applicable, and must be managed by the user directly with the corresponding insurance company to make them effective.
The foregoing is without prejudice to cases of ticket returns due to event cancellation, changes in date, time, venue, or other circumstances that differ from what was originally communicated to the buyer. If the event is modified or postponed to another date and time, the buyer may choose between: (i) a refund of the total ticket price (which includes the Base Price plus the Service Charge) according to the terms explained in the following paragraph; or, (ii) keeping their original ticket, which will be valid for the postponed event.
In these cases, the Organizer must authorize the refund of the net amounts collected for tickets through the TICKETPLUS platform. The Organizer must indicate to TICKETPLUS the procedure to follow to carry out the proper refund of money to customers, which will be published immediately so that the User has clarity on how to proceed to obtain the money reversal. From that communication, both the ticket price (Base Price) and the Service Charge will be refunded, that is, the total price paid by the User, according to how the ticket was paid. If paid by credit card, the reversal will be processed through the payment method used to the credit card; if paid by debit card, the refund will be made via electronic transfer, after verifying the identity of the buyer of the corresponding tickets; and if the purchase was made through another payment method, the money will be refunded to the account used by that method. In exceptional cases where the payment method does not work for reasons beyond our control, reversals will be made via electronic transfer to the customer's account. The timeframe TICKETPLUS has to process the refund or reversal of funds is approximately 60 calendar days, counted from the date on which the User requested the refund due to cancellation, suspension, or modification of the Event, provided that the User submits the necessary documentation to process the money reversal.
TICKETPLUS shall have no involvement as an agent with respect to tickets sold or delivered directly by the Event Organizer without the use of the TICKETPLUS Platform, or that have been delivered by a third party unrelated to TICKETPLUS as part of a contest, invitation, courtesy, or similar. Refunds for these tickets must be coordinated with the institution or company that delivered them, with TICKETPLUS being exempt from any liability arising therefrom.
EIGHTH: Copyright.
The Organizer may prohibit the entry of cameras, recorders, or other similar devices or equipment (with the exception of mobile phones) through which it is possible to record the event or activity in a visual and/or audio format, in order to protect the copyrights of the artists, performers, or executants of the event.
Additionally, attendees may be searched at the entrance to the event or activity in order to fulfill the objective established in the preceding paragraph and, likewise, for security reasons. In the event that, after the search, an attendee is found carrying bladed weapons, alcohol, or anything else that affects the safety of the event, their access will be denied.
TICKETPLUS may feature third-party content, that is, content from legal entities or natural persons other than the Organizer, on its platform or with links to third-party sites. TICKETPLUS has no involvement in the content contributed or published by said third parties on the TICKETPLUS Platform. In cases where third-party information is published, TICKETPLUS will advise the Organizer who provided the information about the need to obtain the respective authorization in order to protect the copyrights of those third parties.
NINTH: Data Protection and Privacy Policy.
The use of personal data provided by the User in their profile must be previously consented to by the User and shall have the following purposes: (i) Validating ticket purchase orders; (ii) Improving the information and marketing of products and services provided by TICKETPLUS; (iii) Populating the TICKETPLUS database for the purpose of automated data processing for consumer analysis by the Event Organizer; (iv) Proposing improvements regarding the User's experience at the events they attend; and, (v) Being used for commercial purposes of TICKETPLUS and the Event Organizer where the customer purchased a ticket.
The transfer of information to third parties without prior authorization from the User is prohibited, that is, to legal entities or natural persons other than the Organizer or TICKETPLUS.
TICKETPLUS uses the highest technology to safeguard the personal information of Users; however, we inform you that, to date, there is no mechanism that is completely immune to cyberattacks by third parties seeking to intercept or obtain information illegally or without authorization.
The User may always exercise their rights of access, rectification, cancellation, and opposition regarding the processing of their personal data. This shall be carried out through a written communication, attaching a photocopy of their national identity card or equivalent identification document, to the email address consultas@ticketplus.cl.
TICKETPLUS does not store information related to the User's payment methods, nor does it carry out a validation process of the information registered by the User in their profile; therefore, it is the User's responsibility to ensure that this information is up to date and truthful. For issues directly related to the payment method, the User must contact the corresponding banking entity, and TICKETPLUS may provide all the assistance the User needs to resolve the issue with said entity.
The Customer authorizes TICKETPLUS to send promotional and/or advertising communications for products associated with events of various kinds, such as artistic, cultural, and/or sporting shows, with which TICKETPLUS is associated. If the Customer does not wish to receive communications, they may request the cessation thereof by sending an email to marketing@ticketplus.cl, expressing their refusal.
TENTH: Liability.
TICKETPLUS is solely responsible for the operation of the website www.ticketplus.cl and for the purchase of tickets through it. The Event Organizer shall make available to Users all necessary information so that they have a complete understanding of the event, in particular informing about the type of event, the venue where it will take place, the date, time, location, etc. The Organizer shall be responsible for any lack of truthfulness, accuracy, and validity of the information provided about their event.
TICKETPLUS uses the highest technology to safeguard its TICKETPLUS Platform, which does not absolutely prevent third parties, commonly known as “hackers,” from infecting or damaging the Website.
ELEVENTH: Event Liability.
TICKETPLUS acts as an agent for Event Organizers and is solely responsible for the sale of tickets and associated products through its TICKETPLUS Platform. Therefore, the Organizer is directly responsible for what happens at the event, whatever it may be, for its cancellation or postponement, and for the safety of attendees. TICKETPLUS bears no responsibility in any area related to the event and is only responsible for the website and the sale of tickets through it. In case of problems during the event, whatever they may be and unrelated to the E-Ticket, please contact the Event Organizer.
The Organizer is the one who carries out the ticket validation process at the event venue. TICKETPLUS may be additionally contracted by the Organizer to perform the validation process.
TWELFTH: TICKETPLUS Platform Inactivity.
The TICKETPLUS Platform may be inactive in the following cases:
Scheduled maintenance: consisting of a planned service shutdown for the purpose of carrying out maintenance thereof.
Force majeure: for the purposes of this instrument, force majeure events shall be considered as those circumstances that could not have been foreseen, or that, if foreseen, were unavoidable, and that prevent the affected party from fulfilling its respective obligations under the Terms and Conditions. The foregoing, in accordance with the provisions of article 45 of the Civil Code.
Provided the requirements of article 45 of the Civil Code are met, the following events, among others, may be invoked as grounds for Force Majeure: (i) Outbreak of war, declared or not, military invasion, or armed hostilities; (ii) Outbreak of riots, insurrection, civil unrest, or civil war; (iii) Acts of piracy; (iv) Earthquake of a magnitude greater than 7.0 on the Richter scale, volcanic eruption, hurricane, flood, or other natural disasters; (v) Accidents directly derived from a Force Majeure event; (vi) Outbreak of a serious disease or epidemic, quarantines, or other public health emergencies; (vii) Strikes, work stoppages, or any type of labor conflict, legal or illegal, that affects the operation of the system; (viii) Viruses; (ix) Network connectivity errors, or any other cause of service unavailability that is beyond the reasonable reach or control of TICKETPLUS SPA.
